Terms and Conditions of Sale
1. About us
The website is operated by [IMAANI LEGAL COMPANY NAME], trading as IMAANI, company number [COMPANY NUMBER], VAT number [VAT NUMBER], with its registered or trading address at [REGISTERED / TRADING ADDRESS]. Contact us at [CUSTOMER-SERVICE EMAIL] or [CUSTOMER-SERVICE PHONE].
2. Who may place an order
You must be at least 18 years old and legally capable of entering a contract. Products are intended for domestic use unless we agree otherwise in writing.
3. Product information
We take reasonable care with descriptions, dimensions and images. Screen settings, lighting, fabric direction and dye batches can affect the appearance of colour and texture. Upholstered and handmade products may have small tolerances in dimensions, pattern placement, seam position and padding. These natural or manufacturing tolerances are not faults unless they materially depart from the description or agreed specification.
4. Measurements and access
Overall bed dimensions are normally larger than the mattress size. You are responsible for checking product, package and access dimensions before ordering. Advice from our team is based on information you provide and does not replace your own measurement of the property.
5. Prices and promotions
Prices include VAT where applicable but may exclude optional services or postcode surcharges. Promotions, discount codes and crossed-out reference prices are subject to their stated terms and dates. Only one code may be used unless we expressly say otherwise. If a pricing error is obvious and could reasonably have been recognised, we may contact you to correct or cancel the order before acceptance.
6. Placing and accepting an order
The checkout acknowledgement confirms receipt, not acceptance. A binding contract is formed when we send an acceptance or dispatch/production confirmation, depending on the order process. We may decline an order because of product availability, an unserviceable address, a pricing error, suspected fraud or another reasonable commercial or legal reason.
7. Payment and finance
Payment must be authorised using an accepted method. Pay-later and finance products are provided by third parties, subject to eligibility, their terms and credit checks. IMAANI is not the lender unless expressly stated. Cancelling the goods may also require the linked finance agreement to be adjusted or cancelled by the provider.
8. Made-to-order and personalised goods
A product may be made to order when you select its size, fabric, colour, storage, headboard or other configuration. However, the legal exception to cancellation applies only where the goods are genuinely made to your specification or clearly personalised. We will identify relevant products before purchase where possible.
9. Changes and cancellation
Contact us quickly if you need to change an order. Changes may affect price and delivery. The separate Cancellation Policy explains the first 24 hours, reasonable production costs of up to £90 for a bed frame or £120 for an ottoman bed, and the position for genuinely bespoke goods. Statutory rights take priority.
10. Delivery
The standard estimate is 7–10 working days unless another lead time is stated. Deliveries may take place Monday to Saturday between 7am and 9pm, normally with 24–48 hours’ notice. The Delivery Policy forms part of these terms, including access duties, second-floor limits for flats without a usable lift and the £50 missed-delivery charge.
11. Risk and ownership
Risk passes when the goods are delivered to you or a person you nominate. Ownership passes when we receive full payment. Where a finance provider pays us, its agreement may contain additional ownership or security provisions.
12. Assembly and services
Optional services cover only what is described at checkout or in writing. You must provide safe access and a clear working area. Services already fully performed are generally non-refundable, subject to your legal rights where a service is not carried out with reasonable care and skill.
13. Returns and refunds
The Returns & Refunds Policy forms part of these terms. It includes legal cancellation rights, the additional 28-day goodwill policy, £150 standard bed-frame collection, £180 ottoman collection, product-condition requirements and bespoke/hygiene exclusions.
14. Faulty goods
Nothing in these terms limits your rights where goods are faulty, not as described or unfit for purpose. We may inspect the product and offer the remedy appropriate under consumer law, including repair, replacement, price reduction or refund.
15. Warranty
Eligible structural components carry a 5-year limited manufacturer’s warranty. TV-lift mechanisms, motors and integrated electrical parts carry 2-year cover. Full terms and exclusions appear in the Warranty Policy. The warranty is additional to statutory rights.
16. Liability
We do not exclude liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot lawfully be excluded. We are responsible for foreseeable loss caused by our breach. We are not responsible for business losses where you purchase as a consumer or for losses caused by inaccurate information you supplied, unsafe access or failure to follow clear instructions, except where the law provides otherwise.
17. Events outside reasonable control
We are not responsible for delay caused by events outside our reasonable control, but we will contact you and take reasonable steps to reduce the effect. Where a delay becomes substantial, legal cancellation rights may arise.
18. Personal data
We use personal data as described in our Privacy Policy and Cookie Policy.
19. Complaints and law
Contact us first so we can investigate. These terms are governed by the law applicable to your consumer contract. Consumers living in the UK may bring proceedings in the courts available to them under applicable law. If any clause is unenforceable, the remaining clauses continue.
